This Privacy Policy explains how Anserve, operated by eValue8 BV (both registered in the Netherlands), collects, uses and protects information when you use our platform, website, and services. We are committed to protecting your privacy and complying with the General Data Protection Regulation (GDPR) and applicable Dutch and EU privacy law.

1. Who we are — Data Controller

The data controller responsible for your personal data is:

2. What data we collect

2.1 Account and subscription data

When you create an account or start a subscription, we collect:

  • Name and email address
  • Company name and billing address
  • Payment information (processed by Mollie B.V. — we do not store card details)
  • Subscription plan and usage data

2.2 Chat and conversation data

When visitors use your Anserve-powered chat widget, we process:

  • Chat messages (questions and answers)
  • Email addresses provided voluntarily by the visitor
  • Conversation metadata (timestamp, channel, escalation status)
  • IP address and browser information (for security and fraud prevention)

Chat data is processed on behalf of the organisation that operates the Anserve chatsite (the data processor relationship). That organisation is the data controller for their end-users' data.

2.3 Knowledge base data

When you connect knowledge sources (Confluence, Google Drive, Freshdesk, etc.), the content of those sources is ingested and stored in a dedicated, isolated vector database per organisation. This content is used exclusively to generate answers for your Anserve agent. We do not use your knowledge base content to train shared AI models or share it with other customers.

2.4 Usage and technical data

  • Log data: server logs, error logs, API call records
  • Dashboard usage: which features you use, when, and how often
  • AI cost tracking: token counts per conversation (for billing)

3. How we use your data

  • Service delivery — to operate and improve the Anserve platform
  • Billing — to process payments and calculate AI usage costs
  • Support — to help you with technical questions or escalations
  • Security — to detect and prevent fraud and abuse
  • Legal compliance — to comply with applicable laws and regulations

We do not sell your data to third parties. We do not use your data for advertising purposes.

4. Legal basis for processing (GDPR Article 6)

  • Contract performance — processing necessary to deliver the service you subscribed to
  • Legitimate interests — security, fraud prevention, service improvement
  • Legal obligation — retention of financial records under Dutch law (7 years)
  • Consent — where explicitly obtained (e.g. marketing communications)

5. Sub-processors and third parties

We use the following sub-processors to deliver the service:

  • OpenAI — LLM inference (GPT-4o, GPT-4o-mini) and embeddings. Data processed in the US under standard contractual clauses.
  • Anthropic — LLM inference (Claude) where selected. Data processed in the US under standard contractual clauses.
  • Google — LLM inference (Gemini) where selected, and Google Drive integration. EU data processing available.
  • Pinecone — Vector database for knowledge storage. Region selectable (EU or US).
  • Mollie B.V. — Payment processing. Based in the Netherlands, GDPR-compliant.
  • Amazon Web Services / other hosting — Server infrastructure. EU region used by default.

We ensure all sub-processors provide appropriate data protection guarantees, either through GDPR adequacy decisions, standard contractual clauses, or equivalent safeguards.

6. Data residency

Anserve is a European platform developed and hosted in the EU. You can choose where your vector knowledge base is stored (EU or US) depending on your compliance requirements. Chat logs and account data are stored in the EU by default.

7. Data retention

  • Account and subscription data — retained for the duration of your subscription plus 7 years (Dutch financial record requirements)
  • Chat conversation data — retained for 12 months by default; configurable per organisation
  • Knowledge base content — retained as long as the source connection is active; deleted within 30 days of disconnection or account closure
  • Log data — retained for 90 days

8. Your rights under GDPR

As a data subject under GDPR, you have the right to:

  • Access — request a copy of the personal data we hold about you
  • Rectification — request correction of inaccurate data
  • Erasure ("right to be forgotten") — request deletion of your data
  • Restriction — request that we limit how we process your data
  • Portability — receive your data in a structured, machine-readable format
  • Objection — object to processing based on legitimate interests
  • Withdraw consent — where processing is based on consent

To exercise any of these rights, contact us at privacy@anserve.ai. We will respond within 30 days. You also have the right to lodge a complaint with the Dutch Data Protection Authority (Autoriteit Persoonsgegevens).

9. Cookies

The Anserve marketing website uses minimal cookies:

  • Session cookies — for the chat widget session (functional, no consent required)
  • Analytics cookies — only with your consent

The dashboard application uses session cookies for authentication. These are strictly necessary and do not require consent under GDPR.

10. Security

eValue8 BV is ISO 27001 certified. We implement appropriate technical and organisational measures to protect your data: HTTPS encryption in transit, encrypted storage, isolated per-organisation vector databases, access controls, and regular security reviews aligned with our ISO 27001 information security management system. In the event of a data breach that affects your rights, we will notify you and the relevant supervisory authority within 72 hours as required by GDPR.

11. Changes to this policy

We may update this Privacy Policy from time to time. We will notify registered users of material changes by email or via the dashboard. The "Last updated" date at the top of this page reflects the most recent revision.
